Terms of Service

These Terms of Service ("Terms") govern your use of Snag Assistant ("Service"), operated by YJY Solutions, a sole proprietorship registered in South Africa and trading as Snag Assistant, with its principal place of business at 41 Bohmer Road, Pinetown, 3610, KwaZulu-Natal, South Africa ("Company", "we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Snag Assistant is a software-as-a-service (SaaS) platform that enables property inspectors to create, manage, and distribute snag inspection reports through the Telegram messaging application. The Service includes voice transcription, photo management, PDF report generation, and team management tools.

2. Account Registration

To use the Service you must create an account and provide accurate, complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately at support@snagassistant.com of any unauthorised use
  • Ensuring all users added to your account are authorised by you

You must be at least 18 years old to create an account. Accounts may not be transferred without our written consent.

3. Free Trial

We offer a 30-day free trial to new accounts. During the trial:

  • You may create up to 3 reports per day
  • Each report may contain unlimited snag items
  • PDF reports will include a "Powered by Snag Assistant" watermark
  • No payment information is required

At the end of the trial period, your account will be suspended unless you subscribe to a paid plan. Your data is retained for 90 days after trial expiry before permanent deletion.

4. Subscription and Payment

4.1 Plans and pricing

Paid plans are available on a monthly subscription basis. Current pricing is displayed at snagassistant.com/pricing. We reserve the right to change pricing with 30 days' notice to existing subscribers.

4.2 Billing

Subscriptions are billed monthly in advance. South African customers are billed in South African Rand (ZAR) via PayFast. International customers are billed in United States Dollars (USD) via Paddle. By subscribing, you authorise us to charge your payment method on a recurring monthly basis.

4.3 Failed payments

If a payment fails, we will retry the charge and notify you by email and Telegram. If payment is not received within 3 days of the due date, your account may be suspended. Suspended accounts retain data for 90 days.

4.4 User limits

Each plan includes a maximum number of users (including the account admin). If you exceed your plan's user limit, you must upgrade to a higher plan. We will notify you when you reach 80% of your user limit.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe any intellectual property rights
  • Transmit spam, malware, or malicious content
  • Attempt to gain unauthorised access to our systems
  • Resell or sublicense the Service without written permission
  • Use the Service in a way that could damage, disable, or impair it
  • Upload content that is defamatory, fraudulent, or otherwise unlawful

6. Your Data and Content

You retain ownership of all data, reports, photos, and content you submit to the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive licence to store, process, and display Your Content solely for the purpose of providing the Service to you.

We do not sell Your Content to third parties. We do not use Your Content to train AI models.

7. Data Retention and Deletion

  • Active accounts: data retained indefinitely while subscription is active
  • Trial expired or cancelled accounts: data retained for 90 days, then permanently deleted
  • You may request deletion of your account and all associated data at any time by emailing support@snagassistant.com

8. Intellectual Property

The Service, including its software, design, trademarks, and content (excluding Your Content), is owned by YJY Solutions and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

9. Third-Party Services

The Service integrates with third-party platforms including Telegram, Groq (voice transcription), PayFast, and Paddle. Your use of these platforms is subject to their respective terms of service. We are not responsible for the actions, content, or policies of third-party services.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy of voice transcriptions.

11. Limitation of Liability

To the maximum extent permitted by applicable law, YJY Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless YJY Solutions, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

Either party may terminate the subscription at any time. We may suspend or terminate your account immediately if you violate these Terms, fail to pay, or if we reasonably believe your use poses a risk to us or other users. Upon termination, your right to use the Service ceases immediately.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa, specifically the jurisdiction of KwaZulu-Natal. Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the jurisdiction of the Durban High Court, KwaZulu-Natal, South Africa.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email and a notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
